Scientific evidence is often more reliable than other types of evidence commonly used in criminal trials – i.e., eyewitness identifications, confessions, and informant testimony. Nevertheless, despite its obvious value, forensic science has not always merited the term “science.” Three developments in the 1990s focused attention on its shortcomings: the advent of DNA profiling, the Supreme Court's “junk science” decision, and a number of wellpublicized crime laboratory scandals. In light of these developments, and in order to take full advantage of the (...) power of forensic science to aid in the search for truth, a number of reforms are needed: Crime laboratories should be accredited, lab procedures should be standardized, and basic research needs to be conducted on many commonly used techniques. Court procedures also require improvement: Defense experts should be more readily available to indigent defendants, and more comprehensive pretrial disclosure of the substance of expert testimony should be provided. The United States Supreme Court has long recognized the value of scientific evidence – especially when compared to other types of evidence such as eyewitness identifications, confessions, and informant testimony. For example, inEscobedo v. Illinois, the Court observed: “We have learned the lesson of history, ancient and modern, that a system of criminal law enforcement which comes to depend on the –confession— will, in the long run, be less reliable and more subject to abuses than a system which depends on (...) extrinsic evidence independently secured through skillful investigation.” Similarly, inDavis v. Mississippi, the Court commented:Detention for fingerprinting may constitute a much less serious intrusion upon personal security than other types of police searches and detentions. Fingerprinting involves none of the probing into an individual's private life and thoughts that marks an interrogation or search. Nor can fingerprint detention be employed repeatedly to harass any individual, since the police need only one set of each person's prints. Furthermore, fingerprinting is an inherently more reliable and effective crime-solving tool than eyewitness identifications or confessions and is not subject to such abuses as the improper line-up and the “third degree.”. The tight connection between racial identities and roots has been called into question in recent years. The tensions between roots and routes and between authenticity and instability frame one of the central problem‐spaces in the black aesthetic tradition. In light of the role that appeals to authenticity have played in the tradition, and in light of the complications that come with those appeals, the following questions emerge: what kind of work can appeals to authenticity appropriately do; are they grounds for (...) criticism, as Lorraine Hansberry seems to think; or are they something else. This chapter addresses these questions by considering some cases such as: Sidney Kasfir's account of Germans in Yorubaland, and designs involving kente cloth. It explains at least five grades of authenticity discourse, all with their roots in the Greek word for principal or genuine (authentikós). (shrink)

Corporate social responsibility is a tortured concept. We review the current state of the art across a number of academic disciplines, from accounting to management to theology. In a world that is increasingly global and pluralistic, progress in our understanding of CSR must include theorizing around the micro-level processes practicing managers engage in when allocating resources toward social initiatives, as well as refined measurement of the outcomes of those initiatives on stakeholder and shareholder interests. Scholarship must also account for the (...) influence of diverse, and even maladaptive, stakeholders as well as more fully incorporate non-Western philosophical and economic perspectives. Based on this review, we pose five questions that scholars from each of these disciplines should address as the CSR field moves forward. We hope our questions provoke deeper thinking and greater rigor and attention to detail in this important area of business research. (shrink)

The World Health Organisation encourages that blood donation becomes voluntary and unremunerated, a system already operated in the UK. Drawing on public documents and videos, this paper argues that blood donation is regarded and presented as altruistic and supererogatory. In advertisements, donation is presented as something undertaken for the benefit of others, a matter attracting considerable gratitude from recipients and the collecting organisation. It is argued that regarding blood donation as an act of supererogation is wrongheaded, and an alternative account (...) of blood donation as moral obligation is presented. Two arguments are offered in support of this position. First, the principle of beneficence, understood in a broad consequentialist framework obliges donation where the benefit to the recipient is large and the cost to the donor relatively small. This argument can be applied, with differing levels of normativity, to various acts of donation. Second, the wrongness of free riding requires individuals to contribute to collective systems from which they benefit. Alone and in combination these arguments present moral reasons for donation, recognised in communication strategies elsewhere. Research is required to evaluate the potential effects on donation of a campaign which presents blood donation as moral obligation, but of wider importance is the recognition that other-regarding considerations in relation to our own as well as others’ health result in a range not only of choices but also of obligations. The relationship between perceptual categorization and organization processes in 3‐ to 4‐month‐old infants was explored. The question was whether an invariant part abstracted during category learning could interfere with Gestalt organizational processes. Experiment 1 showed that the infants could parse a circle in accord with good continuation from visual patterns consisting of a circle and a complex polygon. In Experiments 2 and 3, however, this parsing was interfered with by a prior category familiarization experience in which infants were presented with (...) visual patterns consisting of a pacman shape and a complex polygon. Part 1 of Experiments 2 and 3 showed that the infants recognized the pacman as familiar, and Part 2 demonstrated that the representation of the pacman blocked the subsequent parsing of the circle. The results suggest that a cognitive system of flexible feature creation can override organizational principles with which a perceptual system may come pre‐equipped. (shrink)

In each of two experiments, college students were assigned to two ad hoc groups that competed in a dart-throwing contest. On each trial, one contestant from each team threw a single dart at a standard dart board, trying to come as close as possible to hitting the bull's-eye. Also on each trial, the other participants judged the likelihood that both the Team A contestant and the Team B contestant would come closer to hitting the bull's-eye. In both experiments, participants exhibited (...) a strong wishful thinking effect. They judged the likelihood that their own team members would come closer to be greater than the likelihood that the opposing team members would come closer. Experiment 2 suggested that it was participants' desires, as opposed to some other variable associated with team membership, that influenced their predictions. Experiment 2 also showed that the size of the effect did not depend on whether participants believed that their predictions had been influenced by their team membership. These results help bridge the gap between previous experimental laboratory studies, which have produced inconsistent results, and correlational field studies of sports fans and voters, which have consistently produced large effects. Moral rules come with exceptions, and moral judgments come with uncertainty. For instance, stealing is wrong and generally punished. Yet, it could be the case that the thief is stealing food for their family. Such information about the thief's context could flip admonishment to praise. To varying degrees, this type of uncertainty regarding the context of another person's behavior is ever-present in moral judgment. Hence, we propose a model of how people evaluate others’ behavior: We argue that individuals principally judge (...) the righteousness of another person's behavior by assessing the likelihood that they would act the same way if they were in the person's shoes. That is, if you see another person steal, you will consider the contexts where you too would steal and assess the likelihood that any of these contexts are true, given the available information. This idea can be formalized as a Bayesian model that treats moral judgment as probabilistic reasoning. We tested this model across four studies (N = 601) involving either fictional moral vignettes or economic games. The studies yielded converging evidence showing that the proposed model better predicts moral judgment under uncertainty than traditional theories that emphasize social norms or perceived harm/utility. Overall, the present studies support a new model of moral judgment with the potential to unite research on social judgment, decision-making, and probabilistic reasoning. Beyond this specific model, the present studies also more generally speak to how individuals parse uncertainty by integrating across different possibilities. (shrink)

Using tombstoning (jumping from a height into water) as an example, this article claims that public health policies and health promotion tend to assess the moral status of activities following a version of health maximizing rule utilitarianism, but this does not represent common moral experience, not least because it fails to take into account the enjoyment that various health effecting habits brings and the contribution that this makes to a good life, variously defined. It is proposed that the moral status (...) of health threatening activities should instead be defined by a version of act utilitarianism where both maximizing value and method of calculation are decided by individuals. In this account personal responsibility for health is reduced to the obligation to undertake calculations effectively, comprising of two duties; epistemic and reflective. If there is an individual epistemic duty, it is plausible to suggest that health promotion should present information in a way which facilitates it, but despite the prevalent language of autonomous choice, discussion of health promotion messages, for example, related to drinking and smoking demonstrates that this currently does not happen. Health promotion strategies should seek to encourage reflection about the harm our health effecting behaviour causes others. (shrink)

This paper starts by introducing a tripartite conception of responsibility for health consisting of a moral agent having moral responsibilities and being held responsible, that is blamed, for failing to meet them and proceeds to a brief discussion of the nature of the blame, noting difficulties in agency and obligation when the concept is applied to health‐threatening behaviours. Insights about the obligations that we hold people to and the extent of their moral agency are revealed by interrogating our blaming behavior, (...) and to facilitate this, my own blaming attitudes and actions are analysed in respect of an imagined adult son who seeks thrills by jumping from a pier into the sea, an activity common around coastlines and intended to be analogous in varying degrees to a range of health‐threatening behaviours. I consider my responses to this imagined act in relation to some features of moralism, the excess of morality, concluding that blame can be justified when it is proportionate and within interpersonal relationships. There is evidence that some nurses hold negative blaming attitudes towards groups of patients considered to have caused or contributed to their illness, but this is not justified, not only because of impaired agency, but also because if there is responsibility for health, associated obligations are owed to those who share our lives, and it is those people who are entitled to hold individuals responsible. Nurses who hold negative blaming attitudes towards groups of patients are invited to identify the status of moral agency, the precise natures of their (failed) obligations, and of the patient–nurse relationship. It is concluded that reflection on these matters and the difference between justified blame and moralism demonstrates that blaming behaviour in the context of professional health care is built on nothing stronger than prejudice. This commentary considers the issues of what should be taken as evidence for semantic categorization in infants and why infants display a surprising asymmetry in the categorization of humans versus nonhuman animals. It is argued that perceptual knowledge should be viewed as a potent source of information for semantic categorization, and that the asymmetrical categorization behavior arises as a consequence of the frequency and similarity structure of experience.

The comprehension principle of set theory asserts that a set can be formed from the objects satisfying any given property. The principle leads to immediate contradictions if it is formalized as an axiom scheme within classical first order logic. A resolution of the set paradoxes results if the principle is formalized instead as two rules of deduction in a natural deduction presentation of logic. This presentation of the comprehension principle for sets as semantic rules, instead of as a comprehension axiom (...) scheme, can be viewed as an extension of classical logic, in contrast to the assertion of extra-logical axioms expressing truths about a pre-existing or constructed universe of sets. The paradoxes are disarmed in the extended classical semantics because truth values are only assigned to those sentences that can be grounded in atomic sentences. (shrink)

This chapter begins with a narration of a slave ship's arrival from the Dutch Gold Coast, today's Ghana, to a South American seaport, Suriname, with about 40 blacks. The uprooted Africans used what was at hand, both culturally and materially, to cobble together the beginnings of an African American culture. It appears that these cultures are not so much born as assembled. This introductory chapter attempts to answer four preliminary questions: to paraphrase cultural theorist and sociologist Stuart Hall: what is (...) the black in black aesthetics; in the same spirit: what is the aesthetic in black aesthetics; what good is a philosophy of black aesthetics; and why discuss any of this in terms of assembly. The idea of assembling black aesthetics presupposes that there is a responsible way of appealing to racial blackness. The chapter also indicates the content available in other chapters of the book. This book explores the empirical evidence for Mocombe's consciousness field theory, which describes the origins and nature of consciousness in the universe/multiverse in his overall structurationist theory of phenomenological structuralism. Mocombe utilizes a logical metaphysical materialist approach to understanding the ontological question regarding the nature and origins of consciousness in the universe/multiverse. The work argues that the consciousness field emanates from an emerging fifth force of nature, the absolute vacuum, which constitutes and reproduces human consciousness and practical activities in the (...) multiverse as a frequency wavelength. The work offers three pieces of empirical evidence for Mocombe's consciousness field theory: the Garyian equation, psychonic wave, and life after life. In the end, the book contextualizes the aforementioned evidence within Mocombe's larger theory of phenomenological structuralism, which offers a resolution to the structure/agency problematic of the social sciences. The work concludes by applying Mocombe's phenomenological structural theory to understanding the constitution of contemporary neoliberal identity capitalism under American hegemony from the consciousness field to societal organization and reproduction. Intentional rounding, a process involving the performance of regular checks on all patients following a standardised protocol, is being introduced widely in the United Kingdom. The process has been promoted by the Prime Minister and publicised by the Chief Nursing Officer at the Department of Health as well as by influential think tanks and individual National Health Service organisations. An evidence base is offered in justification. This article subjects the evidence base to critical scrutiny concluding that it consists of poor (...) quality studies and serial misreporting of findings and a failure to consider wider concerns, including transference of evidence to differing health-care systems, and the conflation of perception and quality of care. Political promotion and wide implementation of intentional rounding despite the flimsy and questionable evidence base raise questions about the use of evidence in ethical nursing practice and the status of nursing as an autonomous profession. White men pretending to be black men by blackening their faces and performing, on stage, the peculiar antics that constituted their vision of blackness. This chapter explores how black people sustain themselves under conditions of racial terror, exclusion, and oppression. Eric Lott's point goes beyond shaming and repudiation, though, to suggest that minstrelsy is more, and more interesting, than a garden variety expression of racism. The men who donned blackface did so in an attempt to work out their own identities (...) as Americans, and some chose blackness as a vehicle for this because of a genuine, if paternalistic and complicated, respect for black culture. The point of the work has been to assemble black aesthetics as an object of philosophical study, using the resources, broadly speaking, of analysis, pragmatism, and genealogical cultural criticism and social theory. I once planned to write an essay detailing the advantages of a Deweyan approach to philosophical race theory. This essay would have developed my views in a way that highlighted their distinctly Deweyan resonances and debts. A recent essay by Ron Mallon gave me the opportunity to set this plan in motion, as Mallon’s reflections on social constructionism seemed likely to benefit from Deweyan insights. Unfortunately, or fortunately, setting to work on the project led to the distressing but edifying realization (...) that this plan carried with it certain risks, risks made particularly dire by the race-theoretic context. “The Influence of Dewey on Race Theory” will credit this background with an argument that unfolds in two intertwined registers. It will interrogate the impulse to work through Dewey, and it will use the lessons from this exercise—lessons, broadly, about parochialism and politics—as resources for critically engaging Mallon’s argument. Social expectations guide people's evaluations of others’ behaviors, but the origins of these expectations remain unclear. It is traditionally thought that people's expectations depend on their past observations of others’ behavior, and people harshly judge atypical behavior. Here, we considered that social expectations are also influenced by a drive for reciprocity, and people evaluate others’ actions by reflecting on their own decisions. To compare these views, we performed four studies. Study 1 used an Ultimatum Game task where participants alternated Responder (...) and Proposer roles. Modeling participants’ expectations suggested they evaluated the fairness of received offers via comparisons to their own offers. Study 2 replicated these findings and showed that observing selfish behavior (lowball offers) only promoted acceptance of selfishness if observers started acting selfishly themselves. Study 3 generalized the findings, demonstrating that they also arise in the Public Goods Game, emerge cross‐culturally, and apply to antisocial punishment whereby selfish players punish generosity. Finally, Study 4 introduced the Trust Game and showed that participants trusted players who reciprocated their behavior, even if it was selfish, as much as they trusted generous players. Overall, this research shows that social expectations and evaluations are rooted in drives for reciprocity. This carries theoretical implications, speaking to a parallel in the mechanisms driving both decision‐making and social evaluations, along with practical importance for understanding and promoting cooperation. The last‐half of seventeenth‐century England witnessed an increasing number of works published questioning the traditional notions of God's work of creation and providence. Ascribing agency to matter, motion, chance, and fortune, thinkers ranging from Hobbes, Spinoza, modern‐Epicureans, and other presented a challenge to the Anglican defenders of social and ecclesiastical order. By examining the genesis of the Boyle Lectures that began in 1692 with a bequest from Robert Boyle, we can see that while the Lecturers—three of whom will be examined (...) in detail (Richard Bentley, John Harris, and William Whiston)—assiduously defended classical notions of the God–world relationship, they did so without a great sense of panic or pessimism. This transitional period in the mode of conflict or concord between religion and science sheds interesting lights on matters such as argument from design, biogenesis without purposive, personal agents, and scriptural exegesis and scientific inquiries.
